Terms and Conditions

Definitions

1. 1. Soccershopworld

2. 2. Client: the person with whom Soccershopworld has agreed. 3. Client: the person with whom SoccerShopworld has agreed.

3. 3. Parties: 3. From SoccerShopworld in customer together.

4. 4. Consumer: a Customer who is an individual acting for private purposes. 4. Consumption: a customer who is an individual acting for private purposes.


Applicability

1. 1. These conditions apply to all quotations, offers, work, orders, agreements, and deliveries of services or products by or on behalf of Soccershopworld.

2. 2. The parties may deviate from these terms and conditions only if they have expressly agreed to do so in writing.

3. 3. The parties explicitly exclude the applicability of additional and/or deviating general terms and conditions of the customer or third parties.

 

Prices

1. 1. All prices charged by The Soccershopworld are in euros, are exclusive of VAT, and exclusive of other costs such as administration costs, levies, and travel, shipping, or transport costs unless expressly stated otherwise or agreed otherwise.

2. 2. Soccershopworld is at all times entitled to adjust all prices for its products or services mentioned in its shop, on its website, or otherwise.

3. 3. Increases in the cost price of products or parts thereof, which SoccerShopworld could not foresee at the time of making an offer or concluding the agreement, may result in price increases.

4. 4. The consumer is entitled to terminate an agreement as a result of a price increase as referred to in paragraph 3, unless the price increase is the result of statutory regulations.

 

Samples/models

If the consumer has received a sample or model of a product, he cannot derive any rights from it other than that it is an indication of the nature of the product, unless the parties have expressly agreed that the products will be delivered under the sample or model.

 

Consequences of late payment

1. If the customer fails to pay within the agreed period, Soccershopworld is entitled to charge interest of 1% per month from the day the customer is in default, whereby part of a month is counted as a whole month.

2. 2. If the customer is in default, it shall also owe extrajudicial collection costs and may be liable to pay any damages to Soccershopworld.

3. 3. Collection costs shall be calculated based on the Fee for Extrajudicial Collection Costs.

4. 4. If the Customer fails to pay on time, Soccershopworld may suspend its obligations until the

The customer has fulfilled its payment obligation.

5. 5. In the event of liquidation, bankruptcy, attachment, or suspension of payment in favor of the customer, Soccershopworld's claims against the customer shall be immediately due and payable.

6. 6. If the customer refuses to cooperate in the performance of the agreement by Soccershopworld, it is still obliged to pay the agreed price to Soccershopworld.

 

Right to take back goods

1. 1. Once the customer is in default, Soccershopworld may invoke the right of repossession in respect of the unpaid products delivered to the customer.

2. 2. Soccershopworld invokes the right of recovery by written or electronic

 

Communication.

3. As soon as the customer is notified of the claimed right of redress, the customer shall immediately return the relevant products to Soccershopworld, unless the parties agree otherwise.

4. 4. The cost of collecting or returning the products shall be borne by the customer.

 

Right to cancel

1. 1. As a customer of Soccershopworld, you can only cancel your order if the item has not yet been dispatched from our warehouse. 2.

 

Right of retention

1. 1. Soccershopworld may invoke its retention of title and, in that case, retain the products sold by SoccerShopworld to the customer until the customer has paid all outstanding invoices relating to SoccerShopworld unless the customer has provided sufficient security for such payments.

2. 2. The right of retention of title also applies under previous agreements from which the customer still owes payments to Soccershopworld.

3. 3. Soccershopworld shall never be liable for any damage the customer may suffer as a result of the use of its retention of title.

 

Settlement

The customer waives its right to settle its debt to Soccershopworld with a claim against Soccershopworld.

 

Retention of title

1. 1. Soccershopworld remains the owner of all delivered products until the customer has fully satisfied all its payment obligations to Soccershopworld under any agreement with Soccershopworld, including claims relating to shortfalls in the performance of the agreement.

2. 2. Until then, Soccershopworld may invoke its retention of title and repossess the goods.

3. 3. Before transferring ownership to the customer, the customer may not pledge, sell, alienate, or otherwise encumber the products.

4. 4. If Soccershopworld invokes its retention of title, the contract shall be dissolved and Soccershopworld shall be entitled to compensation, loss of profit, and interest.

 

Delivery

1. 1. Delivery takes place while stocks last.

2. 2. Delivery takes place at SoccerShopworld unless the parties have agreed otherwise.

3. 3. Delivery of products ordered online takes place at the address specified by the customer.

4. 4. If the agreed price is not paid on time, SoccerShopworld has the right to suspend its obligations until the agreed price is paid in full.

5. 5. In case of late payment, the customer is legally in default and cannot oppose Soccershopworld's late delivery.

 

Delivery period

1. A delivery period given by Soccershopworld is indicative and does not entitle the customer to rescission or compensation if it is not met unless the parties have expressly agreed otherwise in writing.

2. 2. Delivery commences as soon as the customer has fully completed the (electronic) ordering process and received a (electronic) confirmation of its order from Soccershopworld.

3. 3. Exceeding the stated delivery time does not entitle the customer to compensation or the right to dissolve the agreement unless Soccershopworld cannot deliver within 25 working days or if the parties have agreed otherwise.

 

Actual delivery

The customer must ensure that the actual delivery of the products ordered by it can take place on time.

 

Transport costs

Transport costs shall be borne by the customer unless the parties have agreed otherwise.

 

Packing in shipment

1. 1. If the packaging of any delivered product is opened or damaged, the customer shall have a note made by the shipper or the delivery person before taking delivery of the product. Failing which, Soccershopworld cannot be held liable for any damage.

2. 2. If the customer takes care of transporting any product himself, he shall report any visible damage to products or the packaging before transport to Soccershopworld, failing which Soccershopworld cannot be held liable for any damage.

 

Storage

1. 1. If the Customer orders products later than the agreed delivery date, the risk of loss of quality shall be borne entirely by the Customer.

2. 2. Any additional costs resulting from premature or late acceptance of products shall be borne entirely by the customer.

 

Guarantee

1. 1. The guarantee for products applies only to defects resulting from defective production, construction, or material.

2. 2. The warranty does not apply in case of normal wear and tear and damage resulting from accidents, modifications to the product, negligence or improper use by the customer, or when the cause of the defect cannot be determined.

3. 3. The risk of loss, damage, or theft of the products that are the subject of an agreement between the parties shall pass to the customer when these products are legally and/or factually delivered, or at least under the control of the customer or of a third party who takes delivery of the product for the customer's benefit.

 

Exchanges

1. 1. Direct exchange of an article is unfortunately not possible. To receive the desired article, you can place a new order and return the other one to us free of charge.

If you wish to re-order an article in a different size, but it has now been increased in price, please contact our customer service.

 

Cancel

1.1. Canceling your order is only possible as long as the item has not yet been shipped from our department store. When canceling your order we charge a 10% cancellation fee.

 

Compensation

The customer indemnifies Soccershopworld against all claims from third parties related to the products and/or services supplied by Soccershopworld.

 

Complaints

1. 1. The customer must examine a product or service supplied by Soccershopworld as soon as possible for any shortcomings.

2. 2. If a delivered product or service does not meet what the customer can reasonably expect from Soccershopworld, the customer must inform Soccershopworld of this as soon as possible, but in any case within one day after discovering the defects. fill.

3. 3. Consumers must inform Soccershopworld boil of the shortcoming within two days after verifying.

4. 4. The customer provides as detailed a description as possible of the shortcomings so that Soccershopworld can respond adequately.

5. 5. The customer must demonstrate that the complaint relates to an agreement between the parties.

Cancellation

1. 1. The customer must notify Soccershopworld in writing.

2. 2. It is the customer's responsibility that a notice of default reaches Soccershopworld (on time).

 

Joint and several liability of the customer

If SoccerShopworld agrees with multiple customers, each of them is jointly and severally liable for the full amount owed to SoccerShopworld under that agreement.

 

Liability of from Soccershopworld

1. 1. Soccershopworld is only liable for any damage suffered by the customer if and insofar as this damage is the result of intent or gross negligence.

2. 2. If SoccerShopworld is liable for any damage, it is only liable for direct damage arising from or related to the execution of an agreement.

3. 3. SoccerShopworld is never liable for indirect damage, such as consequential damage, lost profits, missed savings, or damage to third parties.

4. 4. If Soccershopworld is liable, its liability is limited to the amount paid out by a closed (professional) liability insurance, and in the absence of (full) payment of the damage by an insurance company, the amount of liability is limited to (part of the) invoice to which the liability relates.

5. 5. All images, photos, colors, drawings, and descriptions on the website or in a catalog are only indicative and are only approximate and cannot lead to any compensation and/or (partial) dissolution of the agreement and/or suspension they want some obligation.

 

Expiration date

Any right of the customer to compensation from Soccershopworld will in any case lapse within 12 months after the event from which the liability arises directly or indirectly. This does not exclude the provisions of Article 6:89 of the Civil Code.

 

Dissolution

1. 1. The customer has the right to terminate the agreement if Soccershopworld attributably fails to fulfill its obligations, unless this failure does not constitute grounds for termination due to its special nature or because it is of minor significance.

2. 2. If the fulfillment of the obligations by SoccerShopworld is not permanently or temporarily impossible, dissolution can only take place after SoccerShopworld is in default.

3. 3. Soccershopworld has the right to terminate the agreement with the customer if the customer does not fulfill his obligations under the agreement, does not fully or does not fulfill them on time, or if the circumstances give Soccershopworld good reason to fear that the customer is not able to at will be to properly fulfill its obligations.

 

Force Majeure

1. 1. In addition to the provisions of Article 6:75 of the Dutch Civil Code, a failure by Soccershopworld to fulfill any obligation towards the customer cannot be attributed to Soccershopworld in any situation that is independent of the will of Soccershopworld, when the fulfillment of its obligations towards the customer is prevented in whole or in part or when Soccershopworld cannot reasonably be expected to fulfill its obligations.

2. 2. The force majeure situation referred to in paragraph 1 also applies - but not exclusively - to the state of emergency (such as civil war, riot, riot, natural disasters, etc.); non-performance and force majeure of suppliers, suppliers, deliverers or other third parties; unforeseen disruptions to electricity, electricity, internet, computer or telecom equipment; computer viruses, strikes, government measures, unforeseen transport problems, bad weather conditions and work stoppages.

3. 3. If a situation of force majeure occurs as a result of which SoccerShopworld cannot fulfill one or more obligations towards the customer, these obligations will be suspended until SoccerShopworld can fulfill them.

4. 4. From the moment that a force majeure situation has lasted at least 30 calendar days, both parties can terminate the agreement in writing in whole or in part.

5. 5. SoccerShopworld is not liable for compensation in the event of force majeure, even if it has received any benefit as a result of the force majeure situation.

 

Changes to the agreement

If, after the conclusion of the agreement and for its implementation, it appears necessary to change or supplement its contents, the parties will adjust the agreement accordingly promptly and in mutual consultation.

 

Changes to the general terms and conditions

1. 1. Soccershopworld is entitled to change or supplement these general terms and conditions.

2. 2. Changes of minor importance can be made at any time.

3. 3. Important substantive changes will be discussed by Soccershopworld with the customer in advance as much as possible.

4. 4. The consumer has the right to terminate the agreement in the event of a substantial change to the general terms and conditions.

 

Transfer of rights

1. 1. The customer cannot transfer his rights from an agreement with Soccershopworld to third parties without the prior written consent of Soccershopworld.

2. 2. This provision applies as a clause with a property law effect as referred to in Article 3:83 paragraph 2 of the Dutch Civil Code.

 

Consequences of nullity or voidability

1. 1. If one or more provisions of these general terms and conditions prove to be void or voidable, this will not affect the other provisions of these general terms and conditions.

2. 2. A provision that is void or voidable will in that case be replaced by a provision that comes closest to what SoccerShopworld had in mind when drawing up the relevant conditions.

 

Applicable law and competent court

1. 1. All agreements between parties are exclusively governed by Dutch law.

2. 2. The Dutch court in the district where Soccershopworld is located has exclusive jurisdiction in the event of disputes between parties unless the law prescribes otherwise.
